Roadmap to Secure Transactions with Lumena
Please carefully read the following Terms and Conditions of Sale before participating in any auction or private sale organized by Lumena Auctions and Antique Shop.
By registering as a buyer or a bidder and placing bids, you acknowledge and agree to be bound by these terms and conditions.
The terms “Service Provider” refer to Lumena Auctions, “Bidder” refers to the customer bidding at the auction or buyer at a private sale, and “Vendor” refers to the person selling the item at the auction.
Bidder Registration
(a) Bidding Options: Bidders may place bids in person, by telephone, through online absentee bidding, or via online live bidding on the Lumena Auctions website.
(b) Online Bidders: Online bidders must register on the Lumena Auctions website prior to the auction. Registration requires providing accurate personal information and agreeing to comply with the terms and conditions. Lumena Auctions reserves the right to approve or deny online bidder registrations.
(c) Identification: In-person bidders must provide a valid identification document before receiving a bidding paddle. Online bidders may be required to provide proof of identity and residence.
(d) Pre-registration: Bidders are encouraged to pre-register at least 3 working days before the auction day to ensure a smooth bidding experience.
Bidding Process
(a) Bid Acceptance: All bids are subject to acceptance by Lumena Auctions. The auctioneer reserves the right to determine the highest bidder, reject any bids, change bidding increments, withdraw or pass an item, and resolve any disputes.
(b) Successful Bidder: The successful bidder is the person offering the highest bid accepted by the auctioneer. Once the auctioneer declares the item as “sold” or the hammer falls, the successful bidder is responsible for immediate payment.
(c) Item Descriptions: Each auction item is described to the best of our knowledge and expertise, including information on origin, style, age, materials, and any known imperfections. However, all descriptions are statements of informative opinions and should not be considered categorical statements of fact. Bidders are encouraged to inspect items personally or use alternative means to satisfy themselves regarding the item’s description before bidding.
Payment Policy
(a) Buyer’s Premium: In addition to the hammer price, the successful bidder is required to pay a buyer’s premium as specified in the auction’s terms and conditions. The buyer’s premium will be added to the final bid price.
(b) Payment Method: Lumena Auctions accepts various payment methods, including bank transfers, credit cards, or other agreed-upon methods. Payment must be made within the specified timeframe outlined in the auction’s terms and conditions.
Collection and Shipping
(a) Collection Responsibility: Bidders are responsible for arranging the collection, packing, and transportation of purchased items. Any costs related to handling, shipping, insurance, taxes, customs charges, or missing or damaged items are the bidder’s responsibility. The Service Provider is not responsible for the cost of handling, shipping, insurance, tax, customs charges, or any missing or damaged items.
(b) Collection Timeframe: Bidders must arrange for the collection of purchased items within the specified timeframe mentioned in the auction’s terms and conditions. Failure to collect the items within the specified period may result in additional fees or actions at Lumena Auctions’ discretion.
If the bidder fails to collect the auctioned items within the specified period, a management fee of 5% of the item’s value per month will be charged. If the bidder fails to collect the items within 3 months, Lumena Auctions reserves the right to cancel the bidding, resell or re-auction the item, or return it to the vendor. Lumena Auctions retains the right for final interpretation and judgment in any event that may arise.
Final Sale
All sales are final. Once the item is declared sold, ownership transfers to the successful bidder, and no returns, exchanges, or refunds will be accepted unless otherwise stated in the auction’s terms and conditions. Bidders are advised to carefully review all item descriptions and make their own assessments before placing bids. No returns or refunds will be granted.
Limitation of Liability
Lumena Auctions shall not be held liable for any errors, omissions, or inaccuracies in item descriptions, bidding processes, or any other aspect of the auction. Bidders participate at their own risk, and Lumena Auctions will not be responsible for any loss, damage, or injury arising from participation in the auction.
Governing Law and Jurisdiction
These Terms and Conditions of Sale are governed by and construed in accordance with the laws of Cebu City, Philippines. Any disputes arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of Cebu City, Philippines.
By participating in a Lumena Auctions sale, bidders signify their acceptance of these Terms and Conditions of Sale.
